The order granting paid paternity leave is now generated through EMAS

After the employee submits a medical certificate confirming the birth of the child, the employer formalizes paternity leave through the EMAS (Labour and Employment Subsystem) by completing the following steps:

  • Upon logging into EMAS, the employer navigates to the “Orders” section and selects the “Create Leave Order” function.

  • In the opened window, the leave type “Paternity Leave” (relevant leave category) is selected.

  • As the legal basis for the leave, Article 125.4 of the Labour Code of the Republic of Azerbaijan is indicated.

  • The duration of the leave is entered in the system as 14 calendar days of paid leave, specifying that it covers the period before and after the child’s birth.

  • After verifying the entered information, the content of the order is generated, confirmed within the system, and the order granting the employee 14 calendar days of paid paternity leave is officially formalized via EMAS.

Note: When generating the order, it is recommended to verify the accuracy of the information provided in the medical certificate (such as the child’s date of birth and the employee’s personal details), as the calculation of the leave period is based on this data.
