Pursuant to Clause 7.0.10-5 of the Law of the Republic of Azerbaijan “On Social Benefits,” a benefit for the upbringing of a child placed in a foster family — including a child under the age of 18 whose disability has been officially determined — is granted upon the conclusion of an agreement between the foster parents and the authority (institution) designated by the relevant executive body regarding the placement of a child aged 0–18, including a child under 18 with a certified disability, into a foster family.
In other words, this benefit may be awarded solely to individuals who are recognised as “foster parents” in accordance with the procedure established by law. Persons appointed as guardians or custodians by local executive authorities are not considered part of a foster family and therefore are not eligible for the aforementioned benefit.
In cases prescribed by law, such persons may instead be granted another benefit — namely, the “benefit for guardians (custodians) of children deprived of parental care.”
