What is the procedure for monitoring after adoption?

After the adoption is approved by the court, monitoring is carried out every quarter in the first year of adoption until the child reaches the age of 18, and at least once a year in subsequent years. During monitoring, the general living conditions of the family (cleanliness and sanitary-hygienic conditions), the financial situation of the family, the medical and mental health of the child; the medical and mental health of the adoptive parents, and the state of care and concern for the child in the family are checked.

When are children deregistered?

Adopted children are removed from the register in the following cases: 
1. Upon death; 
2. Upon reaching the age of 18; 
3. If they are not considered children deprived of parental care in accordance with the Law of the Republic of Azerbaijan "On Social Protection of Children Deprived of Parental Care".

How long and in what form are interviews with parent candidates held?

After the parent-candidate is registered, within 10 working days, the social worker for parents and the social worker for children of the Social Services Agency under the Ministry conduct 2 interviews with the parent-candidate at his/her home. In the first interview, the social worker for parents obtains information about the living conditions of the parent-candidate, interests, family composition, and the attitude of family members to adoption for the purpose of general acquaintance, and at the same time informs the parent-candidate about the adoption process. In the second interview, the social worker for children checks the compliance of the financial and living conditions of the parent-candidate with the needs of the child.

What are the responsibilities of foster parents?

  1. To participate in the relevant trainings of the Ministry of Labor and Social Protection of the Population;

  2. To raise the child, taking care of his/her physical, mental, moral, and ethical development as well as health;

  3. To allow social workers to conduct monitoring related to the child and, with the Ministry’s consent, facilitate the child’s communication with his/her family and relatives;

  4. To cooperate with the Ministry for the successful implementation of individual development plans prepared for the child;

  5. To obtain the Ministry’s official consent if it becomes necessary to travel abroad with the child;

  6. To use the allowance provided for purchasing seasonal clothing for the child as intended and submit supporting documents to the Ministry;

  7. To return the allowance if it is not used as intended.

What is a foster family?

It is a family institution created to allow children deprived of parental care to grow up in a family environment, temporarily or for a long period of time.

What advantages does the foster family model have compared to children growing up in orphanages?

In a family environment, children gain more love, individual care, and social skills. In orphanages, children grow up in a mass system, and individual development is hindered.

How is the future legal status of a child growing up in a foster family determined?

The child remains in the care of the state. If the biological parents do not take him back and do not give him up for adoption, he can remain in the foster family until he reaches adulthood.

How is the fate of the child resolved if the contract with the foster family expires?

The child is placed with another foster family, either in an orphanage, or returned to their biological family.

What is the main purpose of a foster family?

To ensure the child's growth in a healthy environment, to support his/her education, upbringing and social adaptation.

Who are the children who have lost their parents?

Persons under the age of 18 whose both parents are deceased.

Who are children deprived of parental care?

A child under the age of 18 shall be considered deprived of parental care if both parents fall under any of the following categories:

  1. Persons whose identity is unknown;

  2. Persons who have been deprived of parental rights or whose parental rights have been restricted;

  3. Persons who are considered missing without trace, declared legally incapable (or with limited legal capacity), or declared deceased;

  4. Persons serving a sentence in penitentiary institutions;

  5. Persons who refuse to raise their children or to protect their rights and legitimate interests;

  6. Persons who refuse to take their children from social service institutions for children;

  7. Individuals who are considered deprived of parental care in other cases established by law, until they reach the age of 18;

  8. A child under the age of 18 whose one parent has died and the other parent has been determined to have a disability due to a 61–100 percent impairment of bodily functions, or who falls under any of the categories listed above.

How to apply for institutional placement of children deprived of parental care?

To place children deprived of parental care in an institution, the service "Services provided in the field of adoption and children deprived of parental care" is selected in the "e-Services" section of the "e-social" internet portal and the application is formed by entering the "Protection of the rights of children deprived of parental care, acceptance of applications for placement in institutions for children deprived of parental care and removal from those institutions" section.

In what cases are children deprived of parental care placed in state institutions?

If relatives or persons appointed as guardians cannot take care of the child, the child is placed in the care of the state and placed in an orphanage, boarding school, or social service institution.

How long can children deprived of parental care stay in an institution?

The child may remain in the institution until he or she is returned to the family, adopted, or turns 18. Children who continue their education are kept in state care until they complete their education.

What are the income requirements for adoption?

The average monthly income per person in the family must not be less than the minimum subsistence level established for the country (300 manat) for each family member (including the child to be adopted).
